Terms of Service
1. Agreement
These terms are between you and Disproportionate Upside, LLC, a Texas limited liability company, United States (“CreatorOS”, “we”, “us”). By creating an account you agree to them. If you do not agree, do not use CreatorOS.
2. Beta service
CreatorOS is currently a closed, invite-only beta limited to 50 participants. It is provided free of charge. It is under active development, may change or break, and may be discontinued. Do not rely on CreatorOS as the only copy of any media you care about. Keep your originals.
We may end your access, or the beta itself, at any time.
3. Eligibility
You must be at least 18 years old and able to enter a binding contract. You must comply with the terms of every social platform you connect.
4. Your account
You are responsible for activity under your account. Sign-in is through Google, Apple, Facebook, or TikTok — protect those accounts. Tell us promptly of any unauthorised use.
5. Your content
You own your content. Uploading media to CreatorOS transfers no ownership to us.
You grant us a limited, non-exclusive, worldwide, royalty-free licence to store, process, transcribe, analyse, adapt, render, and — when you explicitly approve it — publish your content to the platforms you have connected. This licence exists solely to operate the service for you and ends when you delete the content or your account, except where we must retain a copy to comply with law.
You confirm you hold all necessary rights to the media you upload, including rights to any music, footage, trademarks, and to the likeness and voice of every person appearing in it.
6. Nothing publishes without your approval
CreatorOS generates proposals. No content is published to any platform without your explicit approval. This applies to every path into the system, including automated and agent-driven ones. AI agents connected to your account may prepare and edit drafts; they cannot approve or publish.
You are responsible for what you publish. Review it before approving.
7. Acceptable use
You may not use CreatorOS to create or publish content that:
- infringes anyone’s intellectual property, privacy, or publicity rights;
- is unlawful, defamatory, harassing, hateful, or incites violence;
- sexualises or endangers minors;
- impersonates another person or misrepresents your affiliation;
- contains malware or attempts to compromise the service; or
- violates the terms of any connected platform.
You may not resell CreatorOS, use it to build a competing service, attempt to extract our models or prompts, or circumvent rate limits and usage caps.
We may remove content and suspend accounts that violate these terms.
8. AI-generated and AI-modified content
CreatorOS uses automated systems to propose edits, captions, and adaptations. These outputs may contain errors, and we do not warrant that they are accurate, appropriate, or suitable for publication. You are the editor. Review everything before approving.
Where output was machine-generated or machine-modified we record it (included in your account data export today; an in-product disclosure surface is still being built). You are responsible for meeting any disclosure obligations imposed by the platforms you publish to, or by law in your jurisdiction.
9. Stock footage and music
We plan to provide B-roll footage through Pixabay under its content licence, and music through a third-party catalogue. Neither is connected in any environment CreatorOS runs in today. Once live: Pixabay will not indemnify us or you against claims arising from its catalogue, and we cannot verify the provenance of every asset in it — you will use stock footage at your own risk, and we will record which stock assets appear in each of your Posts, so if an asset is later found to be infringing we can identify the affected content and notify you. Music will be usable only within content created in CreatorOS, subject to that catalogue’s terms, and you will not be permitted to extract or redistribute catalogue tracks separately.
10. Connected platforms
CreatorOS publishes to Instagram, TikTok, YouTube, and X through their APIs. Those platforms are independent of us. Their availability, rules, rate limits, and behaviour can change without notice, and a platform may reject, remove, or restrict content we submit for you. We are not responsible for platform decisions.
Instagram publishing requires a Professional account. Where a platform does not permit publishing on your behalf, CreatorOS instead prepares the finished file for you to post yourself.
11. Service availability
We provide no uptime commitment during beta. Processing may be delayed, degraded, or unavailable, and generation may halt if a Post exceeds our processing budget.
12. Disclaimers
CreatorOS is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that output will be accurate, on-brand, or suitable for publication.
We make no representation about the performance of any content you publish.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
Our total liability for any claim arising from your use of CreatorOS is capped at the amount you paid us in the 12 months before the claim arose. Because the beta is provided free of charge, that cap is currently $0.
Nothing here excludes liability that cannot lawfully be excluded.
14. Indemnity
You will indemnify and hold us harmless against claims arising from your content, your use of the service, or your breach of these terms.
15. Termination
You may delete your account at any time. We may suspend or terminate access at any time during beta. On termination we delete your data as described in the Privacy Policy. Content already published to a platform remains published — you control it there.
16. Changes
We may change these terms. Material changes will be notified before taking effect. Continuing to use CreatorOS after that constitutes acceptance.
17. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.
